This limited warranty gives you specific legal rights. You may also have other rights that vary from state to state. California consumers may have additional rights under the Song-Beverly Consumer Warranty Act (California Civil Code § 1790 et seq.) and other applicable California law.
For purposes of this arbitration section: (a) the terms "we," "us," and "our" refer to Rapid Wrench Auto Care, LLC, its owners, employees, agents, successors, and assigns; and (b) a "Claim" means any pre-existing, present, or future claim, dispute, or controversy between you and us arising out of or in connection with this limited warranty or any other warranties, express or implied, including any failure of warranty and the validity of this arbitration agreement.
Except where prohibited by law, any claim must be resolved through binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. Arbitration replaces the right to go to court, including the right to a jury trial and the right to participate in a class action. The arbitrator's decision will be final and binding, subject to limited review under applicable law. To begin arbitration, a party must send a written demand to the other party. You may opt out of this arbitration agreement within thirty (30) days of the date of your first purchase by notifying us in writing.
Nothing in this arbitration agreement prevents either party from seeking emergency relief in a court of competent jurisdiction in Los Angeles County, California.
To the maximum extent permitted by applicable law, Rapid Wrench Auto Care, LLC's total liability to you for any claim arising out of or related to parts or services provided shall not exceed the amount you actually paid for the specific part or service giving rise to the claim. This limitation applies regardless of the form of action, whether based on contract, warranty, tort (including negligence), strict liability, or any other legal or equitable theory.
This limitation of liability does not apply to: (a) claims arising from gross negligence or willful misconduct by Rapid Wrench Auto Care, LLC; (b) claims for personal injury or death caused by our services; (c) claims based on fraud or intentional misrepresentation; or (d) any rights you may have under the Song-Beverly Consumer Warranty Act or other applicable California statutes that cannot be waived by contract.
In no event shall Rapid Wrench Auto Care, LLC be liable for any indirect, incidental, special, consequential, or punitive damages of any kind, including but not limited to loss of use of your vehicle, lost profits or income, cost of substitute transportation, towing charges, rental car expenses, or any other economic loss, even if Rapid Wrench Auto Care, LLC has been advised of the possibility of such damages.
Some states, including California in certain circumstances, do not allow the exclusion or limitation of incidental or consequential damages for consumer goods and services. To the extent such limitations are prohibited by applicable law, the above exclusion may not apply to you. This limited warranty gives you specific legal rights, and you may also have other rights that vary by state.
In compliance with California Bureau of Automotive Repair (BAR) regulations and the California Automotive Repair Act (Business and Professions Code § 9880 et seq.), Rapid Wrench Auto Care, LLC discloses the following regarding parts used in your vehicle service:
Where applicable, customers are offered the choice of new or remanufactured parts — for example, starters and alternators. The type of part selected will be clearly identified on your written estimate and final invoice prior to installation. Warranty coverage periods apply equally to new and remanufactured parts unless otherwise noted on your invoice.
Remanufactured parts are professionally rebuilt to meet or exceed original equipment manufacturer (OEM) specifications. Rapid Wrench Auto Care, LLC makes no representation that remanufactured parts are equivalent to new OEM parts beyond the warranty terms stated herein.
This limited warranty is immediately void, in whole or in part, under any of the following circumstances:
Rapid Wrench Auto Care, LLC reserves the right to inspect the vehicle prior to authorizing any warranty claim. Warranty coverage is subject to verification of the original service invoice and mileage records.
Many vehicles, particularly those with age, high mileage, or prior exposure to weather and road conditions, may contain components that are already degraded, corroded, brittle, or at the end of their serviceable life at the time service is requested. This includes, but is not limited to, rusted or corroded fasteners and bolts, brittle or aged plastic clips, tabs, wire harness connectors and retainers, deteriorated seals and gaskets, and seized or stripped hardware. Rapid Wrench Auto Care, LLC is not liable for the failure, breakage, or deterioration of any component that was already in a degraded or compromised condition prior to the commencement of service. The failure of such components during service is considered a pre-existing condition of the vehicle and not the result of workmanship by Rapid Wrench Auto Care, LLC.
Certain repairs require a technician to access, disturb, or remove components that are adjacent to or connected with the part being serviced. When such components fail during the normal course of service due to their pre-existing condition — and not due to improper technique or excessive force by the technician — the resulting damage is considered incidental and is not covered under this limited warranty. Common examples include plastic wire harness clips or retainer tabs that fracture upon release, corroded bolts or fasteners that shear during removal at proper torque, and aged seals or gaskets that deteriorate upon disassembly.
If a technician encounters a pre-existing condition during service that presents a reasonable risk of incidental damage — such as a visibly corroded bolt, a seized fastener, or a brittle component that must be disturbed to complete the repair — Rapid Wrench Auto Care, LLC will pause work and notify the customer before proceeding. Upon notification, the customer may: (1) authorize the technician to proceed, acknowledging the risk of incidental damage to the affected component; (2) authorize additional repair or extraction services as described below; or (3) decline further service, in which case the vehicle will be returned in its current condition and any work completed to that point will be billed accordingly. Customer authorization to proceed following notification constitutes acceptance of the risk of incidental damage to the identified component and releases Rapid Wrench Auto Care, LLC from liability for the failure of that specific component.
When a bolt or fastener breaks due to corrosion, rust, or pre-existing deterioration during the course of an authorized repair, extraction of the broken fastener and installation of a replacement are billable services that require separate customer authorization. These services are not included in the original service estimate or covered under this limited warranty. Rapid Wrench Auto Care, LLC will provide the customer with an updated estimate for extraction and replacement before proceeding. If extraction is not possible in the field due to the nature of the damage or the equipment required, the customer will be advised of alternative service options.
Nothing in this section limits the liability of Rapid Wrench Auto Care, LLC for damage caused by technician error, improper technique, use of incorrect tools, or application of excessive force to a component that was not in a pre-existing degraded condition. Such damage is not considered incidental and remains the responsibility of Rapid Wrench Auto Care, LLC.
The terms and conditions of this limited warranty are incorporated into and form part of the service invoice issued to you by Rapid Wrench Auto Care, LLC. Your signed service invoice, together with this limited warranty, constitutes the entire agreement between you and Rapid Wrench Auto Care, LLC with respect to the parts and services described therein, and supersedes all prior representations, discussions, or agreements, whether oral or written. In the event of any conflict between the terms of this warranty and the service invoice, the terms of the signed service invoice shall govern.

If any provision of this limited warranty is found by a court of competent jurisdiction to be invalid, unlawful, void, or unenforceable for any reason, that provision shall be deemed severed from this warranty and shall not affect the validity or enforceability of the remaining provisions, which shall continue in full force and effect. The unenforceable provision shall be modified to the minimum extent necessary to make it enforceable, consistent with the original intent of the parties.
This limited warranty and any disputes arising hereunder shall be governed by the laws of the State of California, without regard to conflict of law principles. Any legal proceedings not subject to arbitration shall be brought exclusively in the courts of Los Angeles County, California.
